Short Term Rental Regulation Changes for Arizona and Florida

Julian Sage:                       00:36                    Hey, welcome back host nation to another episode of vacation rental machine. I’m Julian Sage and today I am actually with my good friend, Patricia Moore. Patricia is a previous guest on the success stories podcast and she is an expert in the short term rental regulation field. So Patricia is actually going to be one of our new guests that’s going to be coming onto the show and talking to us about some of the regulation things that are happening in the space because it’s very important. So some of the big changes that you’ve probably heard about is the changes in Arizona and the changes happening in Florida. So Tricia, can you please explain what are the current regulations in Arizona and Florida and what are these changes that are gonna be happening and how is this going to affect us as short term rental operators?

Patricia Moore:                01:23                    Absolutely. Julian, thank you so much for having me back. I really appreciate it. I’m really happy to be here with you guys and I’m happy to share some information with you that’s kind of positive in my perception and that has to do with Florida. Previously, Florida has been having to deal with all kinds of regulations all over the state that have been very different. There have been a lot of lies, lawsuits that have been filed by individuals in Daytona beach and then Miami beach, massive fines that have been levied against people that have been struck down recently. But the best thing is that there is a statewide bill in front of Florida right now. And what this bill does is it preempts at the statewide level so that local jurisdictions will not be able to do different regulations for each individual. So the way that it is today, if you’re in Miami beach, you can’t do a short term rental.

Patricia Moore:                02:18                    The way that the laws are written today, you have to rent for six months and one day if you’re going to do any kind of furnish rental. Well, of course, everybody wants to go to Miami beach and a lot of people want to do short term rentals. So it’s a massive issue down there. And this is happening in different places around the state of Florida differently. So in Destin, Florida, they have different regulations. In Daytona beach, they have different regulations, so every little state and city and town can make different regulations associated with it. In this particular case, it would preempt at the statewide level. Basically the bill recognizes that tourism is a huge income achievement for the state of Florida and they would open back up vacant vacation rentals for everybody. And so, it will not allow short, small jurisdictions to change anything.

Patricia Moore:                03:11                    So if you’re in Miami beach, you’d be allowed to do a vacation rental again. However, the laws that they’re going to make in Miami beach would still be true for everybody. So for example, if the law in Miami beaches that you have to be quiet between 10:00 PM and 7:00 AM, that law would now be in effect for everybody, whether you’re a vacation rental or a long-term rental or a resident. And will not make any difference. Everybody has to be quiet between 10 and 7:00 AM. There might be a law with regard to having a barbecue grill that’s too close to the house. That law would be true for everybody. All of the things that are true for one person will be true for everybody. So it’s really kind of, I think a positive thing. It’s been supported by Airbnb. Airbnb has actually put money behind this one and a lot of times Airbnb has not been visible.

Patricia Moore:                04:03                    So there’s been a lot of people that are supporting this one. It looks pretty positive. On the other hand, Arizona and the state of Arizona, it was kind of seen as a very good place to be a short term rental owner. It was opened up at the state level for everybody and now there are a couple of bills in front of the state right now that would significantly change that back down to the local jurisdictions. There would be steep fines associated with any violations. It would require that you have safety devices and noise devices both inside and outside of the house. It requires a your owner or an agent be there to open up the door to let somebody into the property. There’s a possibility that it could increase the taxes. So instead of paying your personal property taxes of say a dollar, I’m just throwing a number out there, it can be four times as expensive for your taxes, which is not good.

Patricia Moore:                05:07                    And it’s set regulations that are very different from longterm rentals. So it really also opens up the possibility for implementing very, very steep fines that are associated with short term rentals. So Florida is looking good. Arizona was previous looking good, and these bills passed the other day. There’s still a lot of steps for them to become law before the governor would sign them, but it’s not really positive. So if you’re in the state of Arizona, get involved, step up. People really need your help and your support to really mold these regulations and making calls and actually being there to testify and going to these meetings and being a show of force makes a big difference to how these laws happen. You’ve gotta be out there to win. So it’s kind of what’s going on.

Julian Sage:                       05:57                    Is there a time frame, Tricia, when these regulations might be coming into effect?

Patricia Moore:                06:05                    I wish I could tell you the actual timeframe, but I don’t know it off the top of my head. These things take awhile to pass. Generally there’s a a couple of months time period when you’re working on stuff at the state level. So it shouldn’t take that long, but I don’t know the actual details about when it is. I can try and find that out for you so you can put it in the show notes if you want to.

Julian Sage:                       06:26                    So Tricia, this is some really big information coming in, really positive for Florida from what it seems like, but also really kind of scary for people that are in Arizona and lots of people like myself, including thought that Arizona was really going to be a place that maybe that would be where we can move operations because it is very friendly. But from what it sounds like there’s lots of changes happening. We don’t really know too much information about what is going to be impacted, but where can we go to find this information? Where can we get more reliable information and get this information directly from the source?

Patricia Moore:                07:02                    Well, you can definitely Google your state and find out exactly where there are associations put together or groups put together. They’re looking into this. You can follow me on Facebook with Airbnb legal barriers if you want to. You can also follow me on LinkedIn and I can answer any questions there. I’ll put updates up on a regular basis of what’s going on and I’ll be happy to feed you guys more information as I know what’s happening. Regulations change every day. So whereas Arizona is actually very positive today, it could change with these new bills and become relatively more difficult. And where regulation, especially in Miami beach is very bad, it could change and go the other way and be very positive. So it’s important to stay involved, to find a local group, to meet with that local group, get engaged, and stay involved because if you’re not involved, it can change overnight. You want to be involved. Stay in it to win it.
